  13.            Non-commercial distribution and/or use  is  permitted  under
  14.            the following terms:

  16.            1)   You may copy and  distribute  verbatim  copies  of  the
  17.                 Maximus-CBCS source, documentation, and executable code
  18.                 as you receive it, in any  medium,  provided  that  you
  19.                 conspicuously and appropriately publish on each copy  a
  20.                 valid copyright notice  "Copyright  1990  by  Scott  J.
  21.                 Dudley"; keep intact the  notices  on  all  files  that
  22.                 refer to this Licence Agreement and to the  absence  of
  23.                 any  warranty;    PROVIDE  UNMODIFIED  COPIES  OF   THE
  24.                 DOCUMENTATION AS PROVIDED WITH THE  PROGRAM;  and  give
  25.                 any other recipients of the Maximus-CBCS program a copy
  26.                 of this Licence Agreement along with the program.   You
  27.                 may charge a distribution fee for the physical  act  of
  28.                 transferring a copy, but no more than is  necessary  to
  29.                 recover your actual costs  incurred  in  the  transfer.
  30.                 Under  no   circumstances   is   Maximus-CBCS   to   be
  31.                 distributed in such a way as to be construed as  "value
  32.                 added" in a sales transaction, such as, but not limited
  33.                 to, software bundled with a modem  or  CD-ROM  software
  34.                 collections, without the prior written consent  of  the
  35.                 author.

  37.            2)   You may modify your copy or copies of  Maximus-CBCS  or
  38.                 any  portion  of  it,  and  copy  and  distribute  such
  39.                 modifications under the terms  of  Paragraph  1  above,
  40.                 provided that you also do the following:

  42.                 a) cause the modified files to carry prominent  notices
  43.                 stating that you changed the files and the date of  any
  44.                 change;
  45.  
  46.                 b) cause the executable code of such  modified  version
  47.                 to clearly identify itself as such in the course of its
  48.                 normal operation;

  50.                 c) if  the  modified  version  is  not  a  "port",  but
  51.                 operates  in  the   same   hardware   and/or   software
  52.                 environment as  the  original  distribution,  make  the

  65.                 warranty protection to some or all  third  parties,  at

  68.                 e) send the complete source code modifications to Scott
  69.                 Dudley at the addresses listed below,  for the  purpose
  70.                 of evaluation  for  inclusion  in  future  releases  of
  71.                 Maximus-CBCS.  Should your source code be  included  in
  72.                 Maximus-CBCS,  Scott  Dudley  retains  all  rights  for
  73.                 redistribution of the code as part of Maximus-CBCS  and
  74.                 all derivative works, with appropriate credit given  to
  75.                 the author of the modification;
  76.  
  77.                 f) You may charge a distribution fee for  the  physical
  78.                 act of  transferring  a  copy,  but  no  more  than  is
  79.                 necessary to recover your actual costs incurred in  the
  80.                 transfer, and you may at  your  option  offer  warranty
  81.                 protection in exchange for a fee;
  82.  
  83.                 g) when distributing modified versions of Maximus-CBCS,
  84.                 you must not change the name  of  the  program  or  the
  85.                 official version number, except to append an identifier
  86.                 which indicates that modifications have been made.  For
  87.                 ports  to  other  operating  systems,   the   following
  88.                 convention must be followed:

  90.                 Maximus-CBCS v<v>.<os>.R<r>
  91.  
  92.                 ...where <v> is the official  Maximus  version  number,
  93.                 <os> is the name of the operating system which the port
  94.                 runs under, and <r> is the OS-specific revision number.
  95.                 For example, the second OS/2 revision of  Maximus  1.02
  96.                 must have a version string in this format:    `Maximus-
  97.                 CBCS v1.02.OS/2.R2'
  98.  
  99.                 Similarly, modifications to Maximus which are  designed
  100.                 to  run  under  MS-DOS  must  also  follow   a   naming
  101.                 convention.  The version string must read:
  102.  
  103.                 Maximus-CBCS v<v>.<i>.<r>
  104.  
  105.                 ...where <v> is the official  Maximus  version  number,
  106.                 <i> is three initials (indicating  your  first,  middle
  107.                 and last names), and <r>  (optional)  is  the  revision
  108.                 number of your modifications.
  109.  
  110.                 For example, a version of Maximus 1.02 modified by  Joe
  111.                 T. SysOp must have a version  string  in  this  format:
  112.                 `Maximus-CBCS v1.02.jts.1'
  113.  
  114.            3)   Mere aggregation of another unrelated program with this
  115.                 program and documentation (or derivative  works)  on  a
  116.  
  117.  
  118.  
  119.                 volume of a storage or  distribution  medium  does  not
  120.                 bring the other program under the scope of these terms.
  121.  
  122.            4)   You  may  copy  and  distribute  Maximus-CBCS  and  its
  123.                 associated documentation (or a portion or derivative of
  124.                 it, under Paragraph 2) in  object  code  or  executable
  125.                 form under the  terms  of  Paragraphs  1  and  2  above
  126.                 provided that you also do one of the following:
  127.  
  128.                 a)  accompany  it  with  the   complete   corresponding
  129.                 machine-readable source code, which must be distributed
  130.                 under the terms of Paragraphs 1 and 2 above; or,
  131.  
  132.                 b) accompany it with a  written  offer,  valid  for  at
  133.                 least three years, to give any third party free (except
  134.                 for a nominal  shipping  charge)  a  complete  machine-
  135.                 readable copy of the corresponding source code,  to  be
  136.                 distributed under the  terms  of  Paragraphs  1  and  2
  137.                 above; or,
  138.  
  139.                 c) accompany it with the information you received as to
  140.                 where the corresponding source code  may  be  obtained.
  141.                 (This alternative is  allowed  only  for  noncommercial
  142.                 distribution and only if you received  the  program  in
  143.                 object code or executable form alone.)

  145.                 For an executable file, complete source code means  all
  146.                 the source code for all modules it contains; but, as  a
  147.                 special exception, it need not include source code  for
  148.                 modules which are standard libraries that accompany the
  149.                 operating system on which the executable file runs.

  151.            5)   You may not copy, sublicense,  distribute  or  transfer
  152.                 Maximus-CBCS and its associated documentation    except
  153.                 as expressly provided  under  this  Licence  Agreement.
  154.                 Any attempt otherwise to copy,  sublicense,  distribute
  155.                 or transfer Maximus-CBCS is void and your rights to use
  156.                 the program  under  this  Licence  agreement  shall  be
  157.                 automatically terminated.

  159.                 However, parties who have  received  computer  software
  160.                 programs from you with this Licence Agreement will  not
  161.                 have their licences terminated so long as such  parties
  162.                 remain in full compliance, and notify Scott  Dudley  of
  163.                 their intention to comply with this Agreement.
  164.  
  165.            6)   If you wish to incorporate parts of Maximus-CBCS into a
  166.                 program which is NOT completely free for ALL users, one
  167.                 with "strings  attached",  then  please  contact  Scott
  168.                 Dudley at one of the addresses listed below.   We  have
  169.                 not yet worked out a simple rule  that  can  be  stated
  170.                 here, but we will usually permit  this.    We  will  be
  171.                 guided by the two goals of preserving the  free  status
  172.                 of all derivatives of our free software (as it pertains
  173.  
  174.  
  175.  
  176.                 to non-commercial use, as provided by  this  Agreement)
  177.                 and of promoting the sharing and reuse of software.
  178.  
  179.            7)   For those who wish to incorporate parts of this  source
  180.                 into  a  program  which  is  FUNCTIONALLY  SIMILAR   to
  181.                 Maximus-CBCS, all of the  regulations  in  paragraph  6
  182.                 also apply.  You cannot use  this  code  without  prior
  183.                 written  permission  form  Scott  Dudley,  if  you  are
  184.                 designing a program which  is  functionally-similar  to
  185.                 Maximus-CBCS.

  187.            8)   For the purposes of this document, "COMMERCIAL USE"  is
  188.                 defined as operation of this software by (or  for)  any
  189.                 corporation, government, company,  foundation,  church,
  190.                 or also any other organization or individual,  for  the
  191.                 purpose of making a profit.  The definition of  "making
  192.                 a profit" includes systems which run  more  than  three
  193.                 modem lines using the  Maximus-CBCS  software,  systems
  194.                 which advertise products for the  system's  sponsor  or
  195.                 system operator, and also those whose system access fee
  196.                 is above and beyond the cost required to  maintain  the
  197.                 system.    Those  wishing  to  use  Maximus-CBCS  in  a
  198.                 commercial environment (as defined  above)  must  first
  199.                 obtain  a  commercial  licence.    Although  commercial
  200.                 licences are usually negotiable, a one-node licence  is
  201.                 presently going for $110 in Canadian currency (CAD$1 ~=
  202.                 US$0.85), and includes the Maximus  software  on  disk,
  203.                 and one free non-bugfix upgrade.  If you're  unsure  as
  204.                 to whether or not you require a commercial licence,  or
  205.                 if you're interested in a  site  licence,  or  even  if
  206.                 you're simply  looking  for  more  information,  please
  207.                 contact the author  at  one  of  the  addresses  listed
  208.                 below.  (If you require information  only,  NetMail  or
  209.                 Email   messages   are   the    preferred    form    of
  210.                 correspondence.)

  217.            WRITING, SCOTT DUDLEY AND/OR OTHER PARTIES PROVIDE  MAXIMUS-
  218.            CBCS "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER  EXPRESSED
  219.            OR IMPLIED, INCLUDING,  BUT  NOT  LIMITED  TO,  THE  IMPLIED
  220.            WARRANTIES OF MERCHANTABILITY AND FITNESS FOR  A  PARTICULAR
  221.            PURPOSE.  THE ENTIRE RISK AS TO THE QUALITY AND  PERFORMANCE
  222.            OF  MAXIMUS-CBCS,  AND  THE  ACCURACY  OF   ITS   ASSOCIATED
  223.            DOCUMENTATION, IS WITH YOU.    SHOULD  MAXIMUS-CBCS  OR  ITS
  224.            ASSOCIATED DOCUMENTATION PROVE  DEFECTIVE,  YOU  ASSUME  THE
  225.            COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

  227.            IN NO EVENT WILL SCOTT DUDLEY BE RESPONSIBLE IN ANY WAY  FOR
  228.            THE BEHAVIOR OF MODIFIED VERSIONS  OF  MAXIMUS-CBCS.  IN  NO
  229.            EVENT WILL SCOTT DUDLEY  AND/OR  ANY  OTHER  PARTY  WHO  MAY

  233.            MODIFY AND REDISTRIBUTE MAXIMUS-CBCS AS PERMITTED ABOVE,  BE
  234.            LIABLE TO YOU FOR DAMAGES, INCLUDING ANY LOST PROFITS,  LOST
  235.            MONIES,  OR  OTHER  SPECIAL,  INCIDENTAL  OR   CONSEQUENTIAL
  236.            DAMAGES  ARISING  OUT  OF  THE  USE  OR  INABILITY  TO   USE
  237.            (INCLUDING BUT NOT LIMITED TO LOSS OF  DATA  OR  DATA  BEING
  238.            RENDERED INACCURATE OR LOSSES SUSTAINED BY THIRD PARTIES  OR
  239.            A FAILURE OF THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS)
